How long does a divorce or khula take in Pakistan?
An uncontested case can move relatively quickly through the family court and arbitration council process, often within a few months. Contested matters — particularly where custody or asset division is disputed — take considerably longer.
Who typically gets custody of children in Pakistan?
Courts apply the welfare-of-the-child standard set out in the Guardians and Wards Act, rather than an automatic rule favouring either parent. Younger children are often placed with the mother (hizanat) in the first instance, but this isn't absolute and depends on the child's specific circumstances.
Can a wife claim maintenance during divorce proceedings?
Yes. Interim maintenance can be applied for while the main case is ongoing, so a spouse isn't left without support during what can be a lengthy process.
